The 2018-19 administration, DOCA, resurrection and liquidation of WA’s Picton Press was widely reported on in this and other forums. Just as it seemed done and dusted, March 2nd will see a Federal Court ‘Examination under oath about the examinable affairs of the company.’ This action has been instigated by the liquidator and Cor Cordis partner Jeremy Nipps through Stacks Lawyers.

Those summonsed include former Picton Press directors, Dennis Hague, Gary Kennedy, Graham Jamieson plus a director of

Quality Press, Amit Shah. The summonses were listed at 2pm on Monday 24th January 2022 for production of documents which will be examined over 2nd and 3rd March in the WA Registry of the Federal Court of Australia. The application was made by Mr Nipps under sections 596A and 596B of the Corporations Act 2001, which states:

“Frauds by officers

             (1)  A person who, while an officer or employee of a company:

                     (a)  by false pretences or by means of any other fraud, induces a person to give credit to the company or to a related body corporate; or

                     (b)  with intent to defraud the company or a related body corporate, or members or creditors of the company or of a related body corporate, makes or purports to make, or causes to be made or to be purported to be made, any gift or transfer of, or security interest in, or causes or connives at the levying of any execution against, property of the company or of a related body corporate.”

In 2019, Picton's 2013 KBA Rapida 106 10-colour B1 press was acquired by Quality Press, with Hague and Jamieson being employed by the successful Perth printer, which services many Eastern State clients. There is no suggestion of any impropriety concerning Quality Press.

It is believed that Mr Nipps' fees as administrator and liquidator were never fully paid and he became an unsecured creditor of the failed company.
