The lengthy Court case involving former Fuji Xerox MD Neil Whittaker, Finance Manager Devlin Bell and accounting firm EY has been adjourned until July 30th by new presiding Judge Feutrill. Recently appointed to the Federal Court, he is now handling the claims and cross-claims case.
In an Administrative Listing, His Honour Feutrill has issued orders that:
The time provided for in order 3 of the orders made by Justice Colvin on 3 November
2021 for the applicants to file and serve:
(a) their evidence in chief, both lay and expert evidence upon which they intend to
rely at trial;
(b) any other documents upon which they intend to rely at trial; and
(c) any further amended pleadings
- Be extended until July 30th 2022.
The case is being heard in the Perth branch of the Federal Court. It has been mired in micro detailed requests for documents and email disclosure by both sides. Under Justice Colvin, he ordered that parties focus on the main issue of the 2016 accounts, which should have been produced already. Parties will have had seven months to settle on document discovery.
