Clear Focus One Way Vision Pty Ltd, who are the sole licensee and importer of perforated, self adhesive One Way Vision window film products (under Australian Patent No. 697657) into Australia, have announced that IP Australia (commonly known as the Australian Patent Office) has completed its long running review of one of the perforated vinyl patents.
This review (called Re-examination) was filed by 3M Australia Pty Ltd in 2007. 3M and their patent attorneys provided a number of reasons and considerable information as to why this patent should be revoked.
The Decision of the Delegate of the Commissioner for Patents made on 27th March 2012 was that there were no grounds for revocation. 3M Australia did not appeal this decision.
Brent Shire, spokesperson for Clear Focus One Way Vision, said “This is a significant and defining moment in our industry. The decision strengthens and adds weight to our case that this important patent is valid. This successful outcome dispels rumours and removes any doubts in the marketplace about the existence, relevance and substance of this patent.”
If you are concerned that your supplier may be selling an infringing product, please contact Brent at Clear Focus One Way Vision for a list of authorised distributors.
This Australian Patent (AU697657) governs intellectual property in the invention and fabrication of One Way Vision films including 50 Patent Claims in the manufacture and use of these vinyls, including laminating. The patent is current and valid. The product range has grown to include 11 different names and types of one way vision films and optically clear laminates, covering internal/external applications and short/long term campaign requirements.
